Existing Single-Family Home Sales decreased 20.8 percent year-to-year in July to a seasonally adjusted rate of 440,370 on an annualized basis.

Median Price of an existing single-family home increased 10.4 percent in July to $314,850, compared with July 2009, and up .9 percent from June.

Unsold Inventory Index increased to 5.8 months in July, compared with 4.0 months in July 2009.

LEGISLATIVE UPDATE
C.A.R. sponsored, SB 1178 (Corbett) has been sent to the Governor. SB 1178 extends anti-deficiency protections to homeowners who have refinanced &quot;purchase money&quot; loans and are now facing foreclosure. Most homeowners were not informed by the lender that when they refinanced their original mortgage, they lost their legal protections and may be personally liable for the difference between the value of the foreclosed property and the amount of the loan. The lenders continue to oppose SB 1178.

C.A.R. sponsored, SB 1427 (Price) has been sent to the Governor. SB 1427 will provide an REO owner notice of a violation of an abandoned property ordinance and opportunity to repair before fines for the violation can attach. SB 1427 requires that the cost of nuisance abatement measures taken by cities be limited to what is actual and reasonable. The measure also requires cities to set the costs for nuisance abatement at a public hearing. 

C.A.R. sponsored AB 1927 (Knight) has been sent to the Governor. AB 1927 re-visited the &quot;right-to-rent issue&quot; of recent C.A.R. sponsored legislation (AB 2259 - vetoed in 2008).  As amended, AB 1927 requires unit owners in a CID to approve, by written ballot, any amendment of the governing documents that would prohibit owners from renting or leasing their unit. Each CID would be permitted to use its own voting approval standards for amending governing documents.

The Governor will have until September 30 to sign or veto bills passed by the Legislature.

The 2009-2010 Legislative Session adjourned on August 31, however, because the Legislature has not delivered a state budget, it is expected that a Special Session will be called in order to allow the Legislature to continue to work on solving the states budget shortfall.

sponsored, SB 1178 (Corbett)</STRONG> has been sent to the
Governor. SB 1178 extends anti-deficiency protections to
homeowners who have refinanced &ldquo;purchase money&rdquo;
loans and are now facing foreclosure. Most homeowners were not
informed by the lender that when they refinanced their original
mortgage, they lost their legal protections and may be
personally liable for the difference between the value of the
foreclosed property and the amount of the loan. The lenders
continue to oppose SB 1178.</FONT></P>
<P><FONT color=#000000><STRONG>C.A.R. sponsored, SB 1427
(Price)</STRONG> has been sent to the Governor. SB 1427 will
provide an REO owner notice of a violation of an abandoned
property ordinance and opportunity to repair before fines for
the violation can attach. SB 1427 requires that the cost of
nuisance abatement measures taken by cities be limited to what
is actual and reasonable. The measure also requires cities to
set the costs for nuisance abatement at a public hearing.
<BR><BR><STRONG>C.A.R. sponsored AB 1927 (Knight)</STRONG> has
been sent to the Governor. AB 1927 re-visited the
&ldquo;right-to-rent issue&rdquo; of recent C.A.R. sponsored
legislation (AB 2259 - vetoed in 2008).&nbsp; As amended, AB
1927 requires unit owners in a CID to approve, by written
ballot, any amendment of the governing documents that would
prohibit owners from renting or leasing their unit. Each CID
would be permitted to use its own voting approval standards for
amending governing documents.<FONT color=#00008b> </FONT></P>
<P><FONT color=#000000><STRONG>The Governor will have until
September 30 to sign or veto bills passed by the
Legislature.</STRONG></FONT></P>
<P><FONT color=#000000><STRONG>The 2009-2010 Legislative Session
adjourned on August 31, however, because the Legislature has not
delivered</STRONG></FONT></P></FONT></FONT></FONT></FONT></TD>

Five mistakes home buyers make
Affordable home prices and historically low interest rates have created an ideal situation for many qualified first-time home buyers to purchase a house.  Despite this opportunity, some buyers may be overconfident and make mistakes during the home-buying process.

MAKING SENSE OF THE STORY FOR CONSUMERS

Some first-time buyers are unaware of the vast amount of paperwork and negotiations that go into purchasing a home.  As a result, buyers may think they can save money by forgoing the use of a REALTOR(R).  However, managing the nuances of offers, inspections, financing, and other pivotal steps when buying a home often causes confusion and anxiety for buyers.  Working with a REALTOR(R)--who is obligated to put the buyer&apos;s best interests first--will help to alleviate buyer concerns during this process.

Online mortgage calculators can help buyers estimate the amount of house they can afford, but calculators should not be the sole source for mortgage-approval information.  Buyers are advised to meet with a mortgage broker or banker prior to beginning the home search to help determine the loan amount for which they are most likely to be approved.

Although there is a large selection of homes available for sale, home buyers should not assume they can make low offers or unreasonable demands.  Even in hard-hit housing markets, homes in desirable neighborhoods are receiving multiple offers.

Home prices gain 3.6 percent in past year
National home prices jumped a substantial 3.6 percent in the past year, according to the S&amp;P/Case-Shiller Home Price Index released Tuesday.  Prices also climbed 4.4 percent in the second quarter compared with a 2.8 percent plunge in the first quarter.

After the mortgage meltdown and the plunge in home prices, record numbers of ordinary houses tumbled into foreclosure across Southern California as borrowers became unable or unwilling to pay their mortgages. The decline in sales over the last two months suggests that the strength in May sales activity was driven by home buyer tax credits which likely pulled forward a number of sales that otherwise would have closed in June or July.


Despite the July homes sale dip, sales in the middle- and high-end markets likely will stabilize for the remainder of the year.  Sales for the $500,000 and below segment likely will be lower than that in the first half the year.

RAA COMMUNICATION ITEMS AVAILABLE FOR YOU
You likely have started receiving questions from your members about the recently approved REALTOR(R) Action Assessment (RAA) added to the 2011 dues billing statement.  To assist you in responding, C.A.R. has developed various information pieces aimed at communicating key messages to your membership about the assessment.  The communication pieces were e-mailed to each Association Executive on Monday, Aug. 23.  

Included in the e-mail were: An e-blast for your association to send to your membership; a letter from C.A.R. President Steve Goddard; a letter that can be modified to include your association&apos;s name and your association president&apos;s name; a feature article for your newsletter or publication; talking points; and a short PowerPoint Presentation.

RED ALERT! Please mobilize your member to urge the Governor to sign SB 1178.
California&apos;s legislature has recently passed SB 1178 (Corbett), C.A.R.&apos;s sponsored bill to extend anti-deficiency protection to homeowners who have refinanced. C.A.R. is asking all California REALTORS(R) to contact Governor Schwarzenegger to urge him to sign SB 1178.

Please urge your members to respond to C.A.R.&apos;s Red Alert. You can get more information about the legislation here: http://takeaction.realtoractioncenter.com/campaign/sb1178. Your members can click on the same link to send the governor a letter urging him to sign the bill. AE PROFESIONAL DEVELOPMENT SEMINAR OCTOBER 5th in ANAHEIM 
&quot;Pick Pocket Guide to Technology&quot; will be the topic of the AE Professional Development Seminar on Tuesday, October 5th, from 1:00 pm - 5:00 pm, in Anaheim.   The seminar will be presented by Terese (Terry) Penza, RCE, CAE, President &amp; CEO of North Shore-Barrington Association of REALTORS(R), Northbrook, IL.  Terry says &quot;many AE&apos;s think most technology and technology gadgets are out of their reach financially and will cost a bazillion dollars!  My quest is to find a way to have all the technology for a fraction of the cost.&quot;

Terry is a fanatic on using technology to assist her members and her association while making it fun.  If you attended the program in February, with Ginger Downs, AE Chicago AOR, this is a follow-up on some of the ideas Ginger presented.  Terry is a dynamic and energetic speaker and this will be a very informative and fun seminar. 2010 HONORARY MEMBER-FOR-LIFE APPLICATION DEADLINE
The 2010 Honorary Member-for-Life application deadline is SEPTEMBER 23rd.  Please note that in order to have the 2011 C.A.R. dues waived, the application must be received by C.A.R. by September 23rd to allow for review and approval at the last Board of Directors meeting for this year.  It is the responsibility of the local association to confirm receipt.

Wednesday&apos;s Mobile Jolt! session will provide a general overview of how to better utilize your Smartphone, while Thursday&apos;s session will show you a ton of great apps to add time savings, business management, and fun to your life. zipForm(R) 6 Training Sessions
In April, all C.A.R. members migrated to the new zipForm(R) 6 platform. Attend any of the zipForm(R) 6 training sessions to strengthen your skills or to learn a few shortcuts and hints. These free sessions are availalbe on Wednesday, Oct. 6 and Thursday, Oct. 7. 

RE BarCamp
RE BarCamp is a free, pre-conference event hosted by volunteers. Topics and sessions are not planned in advance and are borne of the attendees who are interested in participating. Do you have expert insight into some aspect of the real estate transaction that your cohorts don&apos;t? Have you found success in handling a niche issue in the real estate industry? Why not spend 15 to 30 minutes sharing your knowledge with others in the group. The free-form format of RE BarCamp encourages anyone to deliver a session and relies heavily on attendee participation.

Fannie Mae creates Short Sale Assistance Desk to assist REALTORS(R)
Fannie Mae, in cooperation with participating MLSs across the nation, recently developed the Short Sale Assistance Desk to assist real estate professionals with handling issues that may arise following a short-sale offer.  Post-offer short sale issues may relate to servicer responsiveness, the existence of a second lien, or those involving mortgage insurance.

The Assistance Desk will collect and submit information to Fannie Mae using a dedicated submission form on the member&apos;s MLS Web site.  The form then is submitted to Fannie Mae with data to help improve valuations and make quicker decisions regarding short-sale requests.  

The Assistance Desk is designed to assist real estate professionals in cases where the standard approval channel has slowed down, and where Fannie Mae&apos;s intervention may serve as a means for progress towards a resolution.  The Assistance Desk is not intended to replace the standard approval channels, nor is it intended to serve as a compliance or enforcement function, or as a potential appeal for decisions the real estate professional believes to be unfavorable.

Case Shiller Index improves in second quarter
Home prices increased 4.4 percent in the second quarter of 2010 and now are 3.6 percent above their year-earlier levels, according to the S&amp;P/Case-Shiller U.S. National Home Price Index, released yesterday.

The index, which covers all nine U.S. census divisions, recorded a 3.6 percent improvement in the second quarter of 2010 compared with the second quarter of 2009.  

The 10-City and 20-City Composites recorded annual returns of 5 percent and 4.2 percent, respectively, in June.  Following 16 consecutive months of improvement in their annual rates of return, June&apos;s figures were the first to moderate from their prior month&apos;s pace, indicating a possible deceleration in home price returns.

Delinquencies, foreclosure starts decrease in second quarter
The delinquency rate for mortgage loans on one-to-four-unit residential properties decreased to a seasonally adjusted rate of 9.85 percent of all loans outstanding in the second quarter, down 21 basis points from the first quarter, but up 61 basis points from one year ago, according to the recently released Mortgage Bankers Association&apos;s (MBA) National Delinquency Survey.  

The delinquency rate includes loans that are at least one payment past due, but does not include loans in the process of foreclosure.  The percentage of loans in the foreclosure process at the end of the second quarter was 4.57 percent, a decrease of six basis points compared with the first quarter of 2010 but an increase of 27 basis points from one year ago. 

&quot;Ultimately the housing story, whether it is delinquencies, homes sales, or housing starts, is an employment story,&quot; said MBA Chief Economist Jay Brinkmann.  &quot;Only when we see a consistent increase in employment will we see an increase in sales and starts, and a sustained improvement in the delinquency numbers.  Until we see the increase in the number of households that comes with an increase in the number of paychecks, all measures of the health of the housing industry will continue to be weak.&quot;

Mortgage servicers fail to deliver best practices during loan-mod process
A new study finds that mortgage services fail to deliver key service practices more often during the loan modification process than during the loan origination process, according to J.D. Power and Associates.

Among the best practices that mortgage services often fail to deliver include: Providing and meeting a time frame for approval; not requesting information more than once; explaining the entire process during application; and providing proactive status updates during the process. 

The study measures customer satisfaction with five areas of the mortgage-servicing experience: fees; billing and payment process; escrow account administration; Web site; and phone contact.  The study also finds that customers with higher levels of satisfaction may lead to higher levels of loyalty and retention.  Among customers in the prime credit segment, 34 percent of those who are highly satisfied (credit scores of 800 or higher) say they &quot;definitely will&quot; recommend their servicer--compared with 6 percent of customers with lower satisfaction scores.  Similarly, 27 percent of highly satisfied prime credit customers say they &quot;definitely will&quot; select their servicer for a new home mortgage, while 6 percent of less-satisfied customers say the same.

Negative equity continues to improve in Q2 2010
Nearly one quarter (23 percent) of all residential properties with mortgages had negative equity at the end of the second quarter of 2010, down from 24 percent in the first quarter, according to CoreLogic.

Foreclosures, rather than price appreciation, were the primary factor in the change, according to the report.  An additional 2.4 million borrowers had less than 5-percent equity. Together, negative equity and near-negative equity mortgages accounted for nearly 28 percent of all residential properties with a mortgage nationwide.

Negative equity remains concentrated in five states: Nevada, 68 percent; Arizona, 50 percent; Florida, 46 percent; Michigan, 38 percent; and California, 33 percent. 

Homes with more equity are appreciating faster than underwater homes, the report found.  The average values of properties with 50 percent or more equity increased more than 1 percent between Q4 2009 and Q2 2010. Properties with 25 to 50 percent in equity increased an average of 0.2 percent in that period.

California Consumer Confidence rises in August
The California Composite Index of Consumer Confidence increased to 84.2 in August, slightly higher than the May reading of 82.7, according to a survey conducted by the Anderson Center for Economic Research at Chapman University.  An index level lower than 100 reflects a higher percentage of pessimistic consumers compared with those who are optimistic. The Chapman Survey contrasted with a similar survey conducted by the University of Michigan, which showed that consumer confidence at the national level had a lower reading in August than May.

The index measuring consumers&apos; spending plans on big-ticket items improved to 77 in August, while the index measuring current economic conditions increased to 71.9.  The index measuring future economic conditions showed a decline to 100.1 in August from a reading of 105.1 in May.

Home Values rise in second quarter
Home values rose 3.1 percent in the second quarter of 2010 compared with the first quarter, but declined 0.2 percent compared with a year earlier, according to Freddie Mac&apos;s Conventional Mortgage Home Price Index (CMHPI).  

Home values rose in all nine Census Divisions, marking the first time since the second quarter of 2009 that all Census Divisions experienced positive changes in home values.  In the Pacific Division, which includes California, home values rose 3.1 percent in the second quarter of 2010.  Over the last 12 months, home values increased 4.2 percent, and during the last five years, home values have decreased 14.7 percent, according to Freddie Mac.

deliver best practices during loan-mod process<BR></STRONG>A new
study finds that mortgage services fail to deliver key service
practices more often during the loan modification process than
during the loan origination process, according to J.D. Power and
Associates.</P>
<P>Among the best practices that mortgage services often fail to
deliver include: Providing and meeting a time frame for
approval; not requesting information more than once; explaining
the entire process during application; and providing proactive
status updates during the process. </P>
<P>The study measures customer satisfaction with five areas of
the mortgage-servicing experience: fees; billing and payment
process; escrow account administration; Web site; and phone
contact.&nbsp; The study also finds that customers with higher
levels of satisfaction may lead to higher levels of loyalty and
retention.&nbsp; Among customers in the prime credit segment, 34
percent of those who are highly satisfied (credit scores of 800
or higher) say they &ldquo;definitely will&rdquo; recommend
their servicer&mdash;compared with 6 percent of customers with
lower satisfaction scores.&nbsp; Similarly, 27 percent of highly
satisfied prime credit customers say they &ldquo;definitely
will&rdquo; select their servicer for a new home mortgage, while
6 percent of less-satisfied customers say the same.</P>

to improve in Q2 2010<BR></STRONG>Nearly one quarter (23
percent) of all residential properties with mortgages had
negative equity at the end of the second quarter of 2010, down
from 24 percent in the first quarter, according to
CoreLogic.</P>
<P>Foreclosures, rather than price appreciation, were the
primary factor in the change, according to the report.&nbsp; An
additional 2.4 million borrowers had less than 5-percent equity.
Together, negative equity and near-negative equity mortgages
accounted for nearly 28 percent of all residential properties
with a mortgage nationwide.</P>
<P>Negative equity remains concentrated in five states: Nevada,
68 percent; Arizona, 50 percent; Florida, 46 percent; Michigan,
38 percent; and California, 33 percent. </P>
<P>Homes with more equity are appreciating faster than
underwater homes, the report found.&nbsp; The average values of
properties with 50 percent or more equity increased more than 1
percent between Q4 2009 and Q2 2010. Properties with 25 to 50
percent in equity increased an average of 0.2 percent in that
period. </P>

Confidence rises in August<BR></STRONG>The California Composite
Index of Consumer Confidence increased to 84.2 in August,
slightly higher than the May reading of 82.7, according to a
survey conducted by the Anderson Center for Economic Research at
Chapman University.&nbsp; An index level lower than 100 reflects
a higher percentage of pessimistic consumers compared with those
who are optimistic. The Chapman Survey contrasted with a similar
survey conducted by the University of Michigan, which showed
that consumer confidence at the national level had a lower
reading in August than May.<BR><BR>The index measuring
consumers&rsquo; spending plans on big-ticket items improved to
77 in August, while the index measuring current economic
conditions increased to 71.9.&nbsp; The index measuring future
economic conditions showed a decline to 100.1 in August from a
reading of 105.1 in May.</P>

second quarter<BR></STRONG>Home values rose 3.1 percent in the

<P>Home values rose in all nine Census Divisions, marking the
first time since the second quarter of 2009 that all Census
Divisions experienced positive changes in home values.&nbsp; In
the Pacific Division, which includes California, home values
rose 3.1 percent in the second quarter of 2010.&nbsp; Over the
last 12 months, home values increased 4.2 percent, and during
the last five years, home values have decreased 14.7 percent,

The California First-time Buyer Tax Credit has ended, but the New Home Credit still is available.   Earlier this month, the California Franchise Tax Board announced it is no longer accepting applications for the state?s First-time Buyer Tax Credit, but it will continue to accept applications for the state?s New Home Tax Credit until the $100 million allocation is exhausted.  If your clients purchased a previously unoccupied home in California on or after May 1, 2010, and before Jan. 1, 2011, they may qualify for a tax credit of up to $10,000.
