<ga:textBody>One of the most effective, meaningful, and empowering ways to fight for fairness for GLBT Kentuckians is to meet face-to-face with your elected officials. Consider this message your standing invitation to stand shoulder-to-shoulder and arm-in-arm with me in Frankfort, to have those face-to-face meetings.

Our state legislature will be in session for two more months, and several Fairness bills are at stake (see KFA's Legislative Action Center at http://www.kentuckyfairness.org/getinformed/legislation.htm). Plus, we are bracing for anti-fairness bills to be filed in the coming days. I am in my 5th year lobbying for KFA in Frankfort, and am always happy to have citizen lobbyists join me, any day I am there. My hours at the Capitol are 9:00 a.m. - 2:00 p.m. (ET).

Here is my schedule for February:

Wednesday February 10 and Thursday February 11
Wednesday February 17 and Thursday February 18
Wednesday February 24 - KENTUCKIANS VALUE FAIRNESS LOBBY DAY AND RALLY
Thursday February 25

My March schedule, likely to fall again on Wednesdays and Thursdays, to be announced.

If you pick a date to join me at the Capitol, I will contact your state representative and senator and try to set up meetings for us. Just reply to this e-mail and I will follow-up with our Lobbying 101 kit, including directions to the Capitol, and my complete contact information.

<ga:textBody>Recently, the Catholic Archbishop of Louisville has been heard from quite frequently on his staunch opposition to recognizing relationships of lesbian, gay, bisexual, and transgender Kentuckians. It seems to have become the Archbishop's task as of late to draw attention to his position. In response, the following OpEd, which ran in Tuesday's Courier-Journal, was penned to shed light on another religious perspective:

How Faith Speaks To Fairness
By Rev. Albert M. Pennybacker of Lexington

With the current court challenge to California's Proposition 8 forbidding same-sex marriages, religious views are again surfacing. Some are blessed with insight, some with only clamor, bias and stridency. It is critical that religion's positive voice be heard.

Why? It appears that the California case could be headed to the United States Supreme Court. A definitive federal judgment upholding the legality of same-sex marriage would result in striking down state prohibitions including here in Kentucky. Now is the time to sort out what we really believe.

Perhaps in anticipation of this renewed effort to legalize same-sex marriages, Catholic Archbishop Joseph E. Kurtz of Louisville recently re-entered the debate, voicing again his and his church's continuing vigorous opposition. Some other religious leaders in our state share these views. The claim is that their opposition is based in "a received truth" from God, a classic absolutist religious stance. As such it is always one of those human claims that closes off real discussion and across the centuries has often led religious people into rigidity and meanness. And then, it gives God an ugly face.

There are some of us who hold a very different view, one equally grounded in a living religious faith. We favor recognizing same-sex marriages. That is, opposition is not the only or "true" religious position. Deeper than doctrine or ecclesiastical protocols, there is the religious affirmation of the humanity common to us all - God's gift at the heart of human dignity. There is "love your neighbor" ethics and its consequences for our social policies and public life. There is that wonderful vision of the ancient prophets captured in Scripture: "They shall not hurt or destroy on all my holy mountain. ..."

The sad truth is that religious bodies have done more than any other single force to stigmatize and demean people over their sexual orientation. The current opposition to same-sex marriage is one more example. It is simply duplicitous for those holding that view to claim "we embrace the dignity of those with same-sex orientation." It is not unlike the frequent disclaimer "we hate the sin but love the sinner." How ingenuous! Remember, those religious leaders who hold to such opposition are the ones who also oppose legal abortion, divorce, embryonic stem cell research, the use of contraceptives and any living together outside of marriage. It is a flawed religious mind-set toward all human sexuality, with little sense of the need for apology or change.

One contention I find truly puzzling is that same-sex marriage does a "grave injustice" to heterosexual marriage. After having shared more than 50 years in a heterosexual marriage, I dispute the notion that same-sex marriages diminish what I have known. Nonsense! Rather, what heterosexual marriages may provide in strengths, joys, graces and pleasures, including the pleasure of sexual sharing, is exactly what I wish all people to experience whatever their sexual orientation. Instead of being defensive about heterosexual marriage, its positive values need to be available to those with other that heterosexual identities.

As religious people building a view of same-sex marriage we need to clarify our understanding of marriage itself. Marriage happens when any two reasonably adult people faithfully and publicly commit themselves to each other to build and share their life together, hopefully for a lifetime. As such its nature is two-fold, as much a secular as a religious institution. Though every religious community has the right to bless marriages or not according to its own precepts (which our Constitution protects), no religious body has the right to control or pre-empt the state's public interest in marriage.

When as a pastor I officiated at weddings, often as many as 80 to 100 a year, I did so in part as a representative of the state: "...and by the power invested in me by the state of. ..." It continues to be so today (whereas in other countries, two separate weddings typically occur: one secular and the other religious). That bit of wedding ritual honors the state's public side of marriage, what Theodore Olson as an attorney in the current California case describes as a "vital social institution."

That being true it becomes plainly discriminatory to exclude any American from choosing and sharing in the benefits of marriage - social, economic and yes, spiritual. We shall never experience the human equality that lies at the heart of both the religious heritage and the American vision until we rid ourselves of all forms of discrimination based on sexual orientation. As an American Christian and a Kentuckian with deep religious commitments. I hold on to that American social vision, and I hold on to it religiously as a healthy, democratic, non-discriminatory and spiritually compatible hope for our country.

<ga:subjectLine>Hospital Visitation Bill Passes House</ga:subjectLine>
<ga:textBody>Today, the KY House of Representatives passed the Designated Hospital Visitation Bill - HB 118.

It passed with bipartisan support (99-0)!

This legislation will protect families and loved ones by allowing patients in health facilities to designate another adult to be treated as family by hospital staff. This will alleviate the fear of being separated, keep families together at times of medical crisis, and save Kentuckians from being forced to misrepresent their relationships in times of crisis.

"KFA applauds our State Representatives on both sides of the aisle who supported this very important legislation today," said Travis Myles, KFA Board Chairperson. "This type of legislation has passed with similar bipartisan support in other states, including our neighbor - Virginia."

The bill now moves to the Senate where we are hopeful leadership will give this bill consideration.

In Fairness,
Your KFA Team!

<ga:subjectLine>Designated Hospital Visitation Clears House Committee</ga:subjectLine>
<ga:textBody>Join us in celebrating the Kentucky House Health & Welfare Committee's passage of Representative Marzian's Designated Hospital Visitation Bill - HB 118.

It passed the Committee unanimously!

This legislation will protect families and loved ones by allowing patients in health facilities to designate another adult to be treated as family by hospital staff. This will alleviate the fear of being separated, keep families together at times of medical crisis, and save Kentuckians from being forced to misrepresent their relationships in times of crisis.

Place a quick call to thank the bill's primary sponsor Rep. Marzian, Health and Welfare Chair Tom Burch, and the others that joined her in carrying this important legislation. They are Reps. Kelly Flood, Joni Jenkins, Darryl Owens, Ruth Ann Palumbo, Arnold Simpson, and Susan Westrom. You can leave your message for these fair-minded Representatives by calling the Legislative Message Line at 800-372-7181. It is quick, easy to do, and much needed. Fair-minded legislators need to know that their work on these matters is greatly valued.

The bill now moves to the full House where we are hopeful it will receive timely consideration as it did in the 2009 session.

In Fairness,
Your KFA Team!

<ga:subjectLine>Support Education Efforts!</ga:subjectLine>
<ga:textBody>The Kentucky Fairness Alliance Foundation* is a cornerstone for achieving fairness in Kentucky. Education is at the heart of our work to ensure the fairness and dignity of LGBT Kentuckians.

Federal tax laws intentionally encourage charitable giving. Because of the income tax charitable deduction, individuals who make their gifts by December 31 and itemize can significantly reduce their income taxes for 2009.

There are multiple ways of giving end-of-year support:

Gifts of cash - There is no easier way to obtain a charitable deduction for 2009 and support KFA Foundation at the same time than by simply writing a check or paying online. Just be sure your envelope is postmarked by December 31 (P.O. Box 1280, Frankfort, 40602). You can also make your contribution using our secure online system at: https://secure.ga4.org/01/foundation071.

Gifts of stock - Year-end 2009 is an excellent time to consider a gift of stock. Giving long-term appreciated stock offers you two-fold tax savings. First, you avoid paying capital gains tax on the increase in value of your stock. Second, you receive a tax deduction for the full fair market value of the stock on the date of the gift. If this interests you, say so by emailing us today.

Gifts of Real Estate - If you have owned your home, a vacation home, acreage, or a farm for many years, a charitable gift of that real estate can be especially tax advantageous. If given to the KFA Foundation, you avoid the tax and realize a charitable deduction for the full fair market value of the real estate. You may also wish to consider a gift of your personal residence or farm, reserving the right to continue to live in the house for life (and, the lifetime of your surviving partner). Through such an arrangement you will be entitled to a current income tax deduction for a portion of the fair market value of the property. See your tax advisor for details.

Gifts of Life Insurance - If you own a life insurance policy that is no longer needed, consider it as the perfect vehicle for a 2009 year-end charitable gift! To receive a charitable deduction, name the KFA Foundation as both the owner and the beneficiary of the policy. If the policy has a cash value, you can take a charitable deduction approximately equal to the cash value at the time of the gift. In addition, if annual premiums are still to be made and you continue to pay them, those premiums will become tax deductible each year. It?s easy to contribute a life insurance policy to the KFA Foundation. Just check with your life insurance agent for details on which forms to complete.

Through smart priority setting, strategic communications, and vigorous coalition building, the KFA Foundation has a plan to seize every opportunity and make real progress toward fairness in 2010. But we need your help to put this plan into action.

As we face the tough challenges to come in 2010, your active participation and generous support are essential. Please make your tax-deductible gift to the KFA Foundation a year-end priority.

In Fairness,
Your KFA Team

<ga:textBody>Over this holiday season, I have been able to do a lot of reflecting on this past year. To say that it's been a wild year is a gross understatement. We've seen a lot of ups and downs in the GLBT community this year. There are things that brought hope for sure, but there are things that make me aware that our work is far from done both nationally and here in Kentucky.

As a gay man with a partner and young children, I am thankful that my family is gaining more ground in Kentucky. This year, we soundly defeated a bill that would bar GLBT people and families from fostering and adopting children, which would only serve to keep children from loving homes. But I also know that this bill will likely come back sometime in the 2010 legislative session beginning next month. By the same token, I am hopeful that a proactive bill to allow second-parent adoptions will see some action by the Legislature.

And while I am so thankful that I live in an area of the state where my family and I can go to a movie or a restaurant, and that I can put pictures of my family on my desk at work all with legal protections from discrimination, I am sobered by the fact that 75% of the state does not have those same protections. Just 15 miles from my home, there are no such laws.

I see too many emails from people who lose their jobs, face discrimination from public officials, and are worried about their sexual orientation and/or gender identity being discovered in the family court process. But it's these personal stories that both dishearten and energize me at the same time. It's why I'm involved with Kentucky Fairness Alliance. It's why we do that which we do.

It's why we need you to become involved in any way that you can. You can volunteer to work at an information booth. You can come with us to Kentuckians Value Fairness Day in February, the annual fairness lobby day. You can tell your story to your Legislator. You can make a donation online. There is so much work still to be done, and it will take every person to make it happen. Do it for yourself. Do it for your family. Do it for Kentucky!

As the year closes, join me in being thankful about the progress that we've made this year; and in being mindful of the hard work ahead.

In Fairness,

Travis Myles

<ga:subjectLine>Speak Out for LGBT Health Care Reform!</ga:subjectLine>
<ga:textBody>Please join Kentucky Fairness Alliance in the campaign to make sure that America's health care planning includes our communities. We support the work of the National Coalition for LGBT Health and we urge you to let the Department of Health & Human Services know that LGBT people and our families, like all other Americans, should be part of planning for a healthier USA.

The Department of Health and Human Services (HHS) is currently asking for public comment on the development of Healthy People 2020 (HP 2020), which will serve as the federal government's blueprint for a healthier nation for the decade between 2010 and 2020. Healthy People is crucial component of attracting attention, funding, and other resources to improving the health of the LGBT community.

The National Coalition for LGBT Health is asking advocates like you to step up and speak out about the importance of LGBT health issues by participating in the public comment period, which closes on December 31, 2009. The Department is counting on our community to comment on the need for a focus on LGBT health in 2010 and beyond, so make your voice heard!

The website for comments is at http://www.healthypeople.gov/hp2020/Objectives/AddGeneralComment.aspx

The Coalition suggests that comments include a short statement on the following important aspects of LGBT health and the Healthy People process:

- Include gender identity alongside sexual orientation throughout HP 2020

- Include sexual orientation and gender identity in all relevant target areas and objectives

- Include a question about sexual orientation and gender identity on all major federal health surveys, particularly the National Health Interview Survey (NHIS)

If you wish to comment specifically on particular target areas or objectives, go here

More information about each of these points is available from the National Coalition, and they would be happy to help you craft your comments to make a strong case for the development of a comprehensive evidence base on LGBT health disparities and LGBT inclusion throughout Healthy People 2020. They will also be glad to provide you with a detailed list of key target areas and objectives from Healthy People 2010 and the Healthy People 2020 development process.

For assistance with any comment, please contact Kellan Baker, Policy Associate at the National Coalition for LGBT Health, at kellan@lgbthealth.net or (202) 558-6828.

Let's ring in a new year and a new decade of LGBT health advocacy in style: Share your thoughts on LGBT inclusion in Healthy People 2020!</ga:textBody>

<ga:textBody>In November 2007, the documentary company GroundSpark interviewed friends of Josh Shipman at Dunbar High School's Memorial Garden for their film "Straightlaced." Hannah Landers candidly spoke of her love for Josh, the purpose of the Garden and her dismay at the hardships Josh endured as an openly gay and flamboyant individual. Josh Shipman took his own life on October 5, 2006. He was just shy of 16 years old.

In May of 2008, days before Hannah and her mother were to travel to California to continue her interview, Hannah's life was tragically cut short in an automobile accident. Hannah was 17 years old. In an effort to continue Hannah' work and tell Josh's story, the film "Straightlaced: How Gender's Got Us All Tied Up" will premiere in their hometown of Lexington. GroundSpark dedicated the film to Hannah.

Saturday, January 9, 2010
Reception: 10:15 a.m.
Film Showing: 11:00 a.m.
Kentucky Theatre, 214 E. Main St., Lexington

No admission will be charged, but donations are requested. Proceeds benefit the Hannah Landers Scholarship Fund and a contribution to be made to a suicide prevention program in honor and memory of Josh Shipman.
